On October 6, 2021, the U.S. District Court for the District of Minnesota sentenced Tanner J. Sik and Eric J. Weckwerth-Pineda each to 1 year of probation and a $25 special assessment. The co-defendants were also ordered to pay $1,138,772.06 in restitution, jointly and severally. On March 9, Sik and Weckwerth-Pineda pleaded guilty to negligent discharge of a pollutant.

On August 29, 2021, the Federal Motor Carrier Safety Administration (FMCSA) debarred Damir Sisic, owner of the now defunct Sisic Transport Service LLC (STS), for a period of 3 years. On October 14, 2020, Sisic pleaded guilty to conspiracy to falsify Federal records. Specifically, from approximately January 2018 through May 2019, Sisic conspired to falsify the hours of service listed in STS drivers' electronic logs. Truck drivers were routinely exceeding the maximum number of driving hours and “on duty” hours without spending the required hours off duty.

On October 1, FHWA suspended Oglesby Construction, Inc., an Ohio-based roadway striping company, and its former officers, Adam and Gerald Reichert. The suspension will last until the conclusion of legal proceedings.

On September 29, 2021, in the U.S. District Court for the Central District of California, Western Distribution, LLC (Western) and its owner, Carl Bradley Johansson, pleaded guilty to bank fraud and conspiracy to commit bank fraud. Johansson also pleaded guilty to multiple felony charges related to criminal conduct that included ordering the illegal repair of a tanker that resulted in an explosion and the death of one employee and failing to file income tax returns for 6 years.

On September 27, 2021, the U.S. District Court for the District of Utah sentenced Shaun Froelich to 12 months of probation, a $105,000 fine, and a $100 special assessment. On December 1, 2020, Froelich pleaded guilty to one count of major fraud. With another individual, Froelich executed a scheme to obtain money and property by fraudulent pretenses, representations, and promises in a contract with the United States valued at more than $1 million. The conspirators also submitted an invoice requesting payment under the fraudulently obtained contract.

On August 30, 2021, the New York Supreme Court sentenced Ifeanyi Madu to an unconditional discharge and $375 in court fees. On the same date, Madu pleaded guilty to bribe receiving in the second degree, a Class C felony under New York penal law. In April 2018, Madu, the former mid-level manager at the New York City Department of Environmental Protection was indicted by the Manhattan District Attorney’s Office (DANY).

The Federal Aviation Administration (FAA) employs about 13,800 air traffic controllers in more than 300 facilities across the United States. Ensuring adequate staffing and training for controllers is essential to maintain the safety of the National Airspace System, especially at the Nation’s busiest, most complex, and most critical facilities. As we have previously reported, FAA faces challenges with ensuring it has enough fully trained controllers at these critical facilities and with conducting oversight of staffing and training to maintain continuity of air traffic operations.
