On January 21, 2021, a criminal complaint issued by the U.S. District Court for the District of Columbia charged FAA employee Kevin Strong with unlawfully accessing restricted buildings and grounds. Strong was arrested on January 22, 2021. The investigation revealed that on January 6, 2021—after a crowd entered the U.S. Capitol by force—Strong was recorded and photographed in the rotunda. Strong also admitted to being in the U.S. Capitol following the breach.

What We Looked At
This report presents the results of our quality control review (QCR) of KPMG LLP’s management letter related to the audit it conducted, under contract with us, of the Federal Aviation Administration’s (FAA) consolidated financial statements for fiscal years 2020 and 2019. In addition to its audit report on FAA’s financial statements, KPMG issued a management letter that discusses 17 internal control matters that it was not required to include in its audit report.

The Government Charge Card Abuse Prevention Act of 2012 requires us to report to the Office of Management and Budget (OMB) on the implementation of recommendations made to address findings from audits of the Department of Transportation’s (DOT) charge card programs. During 2020, we issued two reports on charge card programs—one pertaining to purchase cards and the other to travel cards. Specifically, we made 13 purchase card and 11 travel card recommendations. DOT agreed to implement all 24 recommendations; however, 21 recommendations remain open.

The Federal Information Security Modernization Act of 2014 (FISMA) requires agencies to implement information security programs. The act also requires agencies to have annual independent evaluations performed to determine the effectiveness of their programs and report the results of these evaluations to the Office of Management and Budget (OMB). To meet this requirement, the Surface Transportation Board (STB) has requested that we perform its fiscal year 2021 FISMA review.

The Federal Information Security Modernization Act of 2014 (FISMA) requires Federal agencies to implement information security programs. The act also requires agencies to conduct annual independent reviews to determine the effectiveness of their programs and report the reviews’ results to the Office of Management and Budget (OMB). We have contracted with an independent public accounting firm to conduct the review of the Department of Transportation’s (DOT) information security program, subject to our oversight.

On January 8, 2021, the U.S. Attorney’s Office for the District of Connecticut entered into a civil settlement agreement with Ducci Electrical Contractors, Inc. Ducci agreed to pay more than $3.2 million plus interest to resolve allegations that it violated the False Claims Act.

On April 15, 2020, a final civil judgment was entered against Yehoshua Vaknin and his company US Moving Services Inc., d/b/a as Safeway Moving & Storage, in the U.S. District Court in the Southern District of Florida. The consent final judgment and stipulated permanent injunction totaled $1,055,455, consisting of $326,000 in restitution against Vaknin and $729,455 in restitution, corporate penalties, and fees against US Moving Services Inc.

On December 31, 2020, the U.S. Attorney's Office for the Northern District of New York entered into a civil settlement agreement with The Fenceman, Inc. Fenceman agreed to pay $109,000 to resolve civil False Claims Act allegations relating to their receipt of Federal aid contracts as a Disadvantaged Business Enterprise (DBE) through the New York State Department of Transportation (NYSDOT).
