United States Attorney John L. Brownlee, Special Agent in Charge Jeffrey R. Roehm, of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Washington Field Division, and Special Agent in Charge James A. Kuiken, of the United States Department of Transportation (USDOT), Office of Inspector General (OIG), Mid-Atlantic Region announced today that Russell Lee Ebersole, age 43, of Hagerstown, Maryland, was indicted yesterday by a federal Grand Jury sitting in Charlottesville, Virginia.

Our audit found an 11 percent reduction in the number of operational errors and 17 percent fewer runway incursions in FY 2002 than FY 2001. Nonetheless, FAA still needs to take additional actions to further reduce the number of incidents and safety risks they pose.

To date 57 individuals have been arrested by FBI and OIG in the household-goods moving case in Florida. The case resulted in indictments issued in March against 16 moving companies and 74 individuals for scheming to defraud customers, primarily by giving “low ball” estimates and then withholding delivery of the goods until an exorbitantly inflated price was paid. Over 325 victims have been identified so far.

The Inspector General testified before the Senate Transportation-Treasury Appropriations Subcommittee regarding the state of the airline industry and FAA. He advised “great care” be taken regarding any Congressional financial relief package to aid the financially distressed industry. In addition, effective cost control is a primary challenge facing FAA, the IG testified. FAA’s budget has increased more than 70 percent—from $8.2 billion in FY 1996 to $14 billion in FY 2004.

William Nicastro of Philadelphia, PA, was sentenced by a U.S. District Court judge in Philadelphia to 1 year in prison, $1,800 in fines, and mandatory drug and alcohol treatment after being found guilty on 13 counts of commercial driver’s license (CDL) fraud. The charges included making false statements to DOT, identity theft, and bank fraud. Nicastro is currently serving the remainder of a 3-year state sentence he received for a joint Pennsylvania and DOT OIG prosecution for forgery.

We will review the revised financial plan for the Woodrow Wilson Bridge Project. Our objective is to determine if the plan, dated December 2002, complies with FHWA’s guidance, specifically whether: (1) estimated costs are reasonable and supported; (2) appropriate and available funding sources have been identified and funds are sufficient to meet the total estimated cost; (3) there is a construction schedule that reflects all known and reasonably anticipated delays; and (4) other factors affecting the project have been disclosed.

We publicly released our review of the Maritime Administration’s (MARAD) Title XI Loan-Guarantee Program, conducted in response to a congressional request. We found MARAD needs more effective oversight of the loan-application process, borrowers, vessels and shipyards constructed under loan guarantees, and foreclosed assets.

This audit will determine whether FAA’s actions to monitor financially distressed air carriers are effective, including whether FAA has effectively used its Air Traffic Oversight System and its Safety Performance Analysis System by providing the data and tools inspectors need to oversee financially distressed carriers.
