On September 13, 2023, FHWA debarred Spectrum Painting Corp., a New York-based painting contractor, from participating in federally funded programs and projects for 3 years. The debarment was in part the result of a Stipulation and Order of Settlement and Dismissal that Spectrum and the United States agreed to in July 2021. In the Stipulation, Spectrum admitted to providing false or fraudulent payment claims and knowingly misrepresenting the work of its employees for two federally funded projects between 2011 and 2013. The projects required Disadvantaged Business Enterprise (DBE) participation, though Spectrum was not a DBE. As part of the Stipulation, Spectrum accepted responsibility for the conduct and agreed to pay $400,000 to the United States.
