FHWA Suspends Michigan Asphalt Paving Company and Two Officials

On September 1, 2023, the Federal Highway Administration (FHWA) suspended F. Allied Construction Company, Inc. (Allied), an asphalt paving company; Andrew Foster, President of Allied; and Kevin Shell, Vice President of Estimating at Allied, from participating in all federally funded programs and projects. In August 2023, Allied, Foster, and Shell pleaded guilty in the U.S. District Court for the Eastern District of Michigan to violations of the Sherman Antitrust Act.
According to the plea documents, Allied, Foster, and Shell participated in a conspiracy to suppress and eliminate competition by agreeing to rig bids for asphalt paving services in Michigan between June 2013 and June 2019, and July 2017 and May 2021.
DOT-OIG is conducting this investigation with the U.S. Postal Service-OIG.
