FHWA Debarred Former Supervisor of Virginia Under-Bridge Inspection Equipment Company
On October 12, 2022, FHWA debarred Kenneth Mix, former Equipment Supervisor at McClain and Co., Inc. (McClain), a Government contractor providing under-bridge inspection (UBI) vehicles and operators to various State DOTs and engineering firms under Federal aid contracts, from doing business with the Federal Government for a 5-year period. The debarment is retroactive from the date of suspension, April 27, 2018.
In March 2020, the U.S. District Court for the District of Connecticut sentenced Mix to a $5,000 fine and a $10 special assessment. In January 2020, Mix pleaded guilty to making a false statement to the Occupational Safety and Health Administration (OSHA). Mix provided a report to OSHA which falsely stated that a third party had inspected a UBI vehicle involved in a workplace fatality three times between 2013 and 2015, and that these inspections met specific standards.
DOT-OIG conducted this investigation with the Department of Labor-OIG with assistance from FHWA.
