Former FMCSA Employee Enters Pretrial Diversion Program

On December 6, 2019, Marcus Mosley, a former safety investigator for the Federal Motor Carrier Safety Administration’s (FMCSA) Illinois Division, entered a 30-day pretrial diversion (PTD) program. The PTD agreement filed in the U.S. District Court, Northern District of Indiana ordered Mosley, a resident of Gary, Indiana, to pay $1,000 in restitution to DOT, among other requirements. On September 19, 2019, a Federal grand jury indicted him for theft of Government property, and he was arrested by Federal agents on September 30, 2019.
 
In 2015, FMCSA terminated Mosley due to his inability to perform the duties of his position, but he failed to return IT equipment and other Government-issued property, including his official FMCSA badge and credentials. When he was arrested on unrelated State charges in May 2019, he used those FMCSA credentials to falsely identify himself as a law enforcement officer.
