Civil Complaint Filed Against Concrete Company and Two Employees

On July 9, 2018, the U.S. Attorney’s Office for the Eastern District of Virginia filed a civil complaint against Universal Concrete Products Corporation (UCP), Stowe, Pennsylvania, and two employees, Donald Faust Jr., president and co-owner, and Andrew Nolan, quality control manager. They were charged with violating the False Claims Act and the Virginia Fraud Against Taxpayers Act.
 
UCP was a subcontractor on the Dulles Metrorail Project, a 23-mile extension of Washington, DC’s existing Metrorail system that will be built in two phases by the Metropolitan Washington Airports Authority (MWAA). Upon completion, the Metrorail extension will be operated by the Washington Metropolitan Area Transit Authority.
 
The Federal Government loaned MWAA approximately $1.2 billion in Transportation Infrastructure Finance and Innovation Act funds to design and build the Dulles project; the loan is administered by DOT. The complaint alleged that Nolan falsified, and directed other personnel to falsify, quality control tests on the concrete used on the project.
 
DOT-OIG is conducting this investigation with the FBI.
